These terms apply to your use of the DigitalIce website at digitalice.me (the “site”). “DigitalIce”, “we”, “us” and “our” means DigitalIce, a business based in New Zealand. By using the site, you agree to these terms. If you don’t agree, please don’t use the site.

1. Using the site

You’re welcome to browse the site, share links to it and contact us through it. You agree not to:

  • use the site in a way that breaks any law, or infringes anyone’s rights
  • try to gain unauthorised access to the site, our systems or other people’s information
  • interfere with the site’s operation, for example by introducing malware or overloading it
  • send spam, misleading or offensive messages through our contact form
  • copy or scrape the site’s content in bulk, or use it to train AI models, without our permission.

We may block access to the site for anyone who breaches these terms.

2. Enquiries, quotes and bookings

Sending an enquiry or booking a call doesn’t create a contract for services. Any work we do for you is covered by a separate written agreement or accepted quote, which sets out the scope, fees, timeframes and other terms. If that agreement conflicts with these terms, the agreement applies.

Calls are booked through our scheduling provider, Skhedio, and its own terms and privacy policy apply to the booking.

3. Information on the site

We describe our services and experience in good faith, but the content on this site is general information only. It isn’t professional, legal, financial or security advice for your situation, and it isn’t an offer to provide services on particular terms. Project examples show what was achieved for those clients; results for your business will depend on your circumstances.

We try to keep the site accurate and up to date, but we may change or remove content at any time.

4. Intellectual property

The site’s content, including its text, design, graphics, code and our logo, is owned by DigitalIce or used with permission, and is protected by copyright and other laws. You may view and print pages for your own reference. You may not otherwise copy, republish or use the content commercially without our written permission.

Client names, logos and project details shown on the site belong to those clients and appear with their permission.

The site links to websites and services run by others, such as our booking page and social media profiles. We don’t control them and aren’t responsible for their content, availability or privacy practices. Please read their terms and policies.

6. Availability and security

We work to keep the site available and secure, but we can’t promise it will always be available, uninterrupted or free of errors or harmful components. We may suspend or change the site at any time, for example for maintenance.

7. Your consumer rights

Nothing in these terms limits any rights you have that can’t be excluded by law, including under the Consumer Guarantees Act 1993 and the Fair Trading Act 1986 in New Zealand, or the Australian Consumer Law.

If you use the site or our services for the purposes of a business, you agree that, to the extent the law allows, the Consumer Guarantees Act 1993 doesn’t apply, and that it is fair and reasonable for you to be bound by this clause.

8. Liability

To the extent the law allows:

  • the site is provided “as is”, and we give no guarantees about it beyond those the law implies and that can’t be excluded
  • we aren’t liable for any loss or damage arising from your use of, or inability to use, the site, or from relying on its content, including indirect or consequential loss, loss of data, profits or business.

Where our liability can’t be excluded but can be limited, it is limited, at our option, to supplying the relevant services again or paying the cost of having them supplied again.

9. Privacy

Our privacy policy explains how we handle personal information you give us through the site.

10. Governing law

These terms are governed by the laws of New Zealand. You and we submit to the non-exclusive jurisdiction of the New Zealand courts.

11. General

If any part of these terms is found to be unenforceable, the rest still applies. If we don’t enforce a right straight away, we haven’t waived it. We may update these terms at any time by publishing a new version on this page; the date at the top shows when they last changed. Continuing to use the site means you accept the updated terms.
